Terms and Conditions

1. General

1.1 These terms and conditions apply to all offers, quotations, assignments, and agreements between SRT Plastics BV, located in [City], registered with the Dutch Chamber of Commerce under number [KvK-number], and its customers, unless explicitly agreed otherwise in writing.
1.2 By using our services or purchasing our products, you agree to be bound by these terms.

2. Offers and Quotations

2.1 All offers and quotations from SRT Plastics are non-binding unless expressly stated otherwise.
2.2 Quotations are valid for the period stated in the quotation. If no period is mentioned, a validity of 30 days applies.
2.3 Obvious errors or mistakes in a quotation are not binding.

3. Agreement

3.1 An agreement is concluded after written confirmation of an order or assignment by SRT Plastics.
3.2 Any additions or changes are only valid if confirmed in writing by both parties.

4. Prices and Payment

4.1 All prices are exclusive of VAT, unless stated otherwise.
4.2 Payment must be made within 30 days of the invoice date, unless otherwise agreed in writing.
4.3 If payment is not received on time, the customer is legally in default and statutory interest will be charged.

5. Delivery and Risk

5.1 Delivery takes place ex-works (EXW), unless otherwise agreed in writing.
5.2 Delivery times are indicative and exceeding them does not entitle the customer to compensation or cancellation.
5.3 The risk of loss or damage to the products passes to the customer upon delivery.

6. Retention of Title

6.1 All delivered goods remain the property of SRT Plastics until the customer has fulfilled all payment obligations in full.

7. Warranty and Complaints

7.1 SRT Plastics guarantees that its products conform to reasonable expectations of quality and performance.
7.2 Complaints must be reported in writing within 8 days of delivery and must be properly substantiated.
7.3 If a complaint is justified, SRT Plastics will, at its discretion, repair or replace the product, or issue a refund.

8. Liability

8.1 SRT Plastics is only liable for direct damage resulting from intent or gross negligence.
8.2 Any liability is limited to the amount invoiced for the relevant delivery.
8.3 SRT Plastics is not liable for indirect damages such as loss of profits, production downtime, or reputational damage.

9. Force Majeure

9.1 In the event of force majeure, SRT Plastics has the right to suspend its obligations or dissolve the agreement in whole or in part without being liable for any damages.

10. Governing Law and Disputes

10.1 All agreements with SRT Plastics are governed by Dutch law.
10.2 Any disputes shall be submitted to the competent court in the district where SRT Plastics is established.
